En vísperas del Día de los Derechos Humanos, la Comisión Interamericana de Derechos Humanos (CIDH) declaró admisible la petición impulsada por el Centro de Ex Combatientes de Islas Malvinas (Cecim) de La Plata, en el que solicitó que se declare “la responsabilidad del Estado argentino por omitir, investigar y juzgar a los miembros de las Fuerzas Armadas que torturaron a los soldados”, así como que se obtenga la “reparación integral” de los veteranos y sus familiares.
Esto significa que el organismo internacional deberá examinar los pormenores del caso para determinar si la petición describe hechos que podrían caracterizar violaciones de derechos humanos protegidos por los instrumentos interamericanos vigentes, a saber, los contenidos de la Carta de la OEA y la Declaración Americana.
A su vez, rechaza la postura del Estado argentino de proscribir la causa bajo excusa de que los hechos denunciados fueron cometidos antes de que la Argentina aceptara la competencia de la CIDH.
“Declarar admisible la presente petición en relación con artículos I, II, III y XVIII de la Declaración Americana; artículos 5, 8, y 25 de la Convención Americana, en concordancia con sus artículos 1.1 y 2; y artículos 1, 6 y 8 de la Convención Interamericana para Prevenir y Sancionar la Tortura”, proclama la resolución, que lleva la firma de Jorge Meza, el Secretario Ejecutivo Adjunto del Sistema de Peticiones y Casos de la CIDH.
El reclamo se basa en la causa que investiga torturas y otras violaciones a las garantías básicas cometidas por oficiales y suboficiales de las FF.AA contra soldados de su misma tropa durante la guerra de Malvinas de 1982, entre las que se encuentran “estaqueamientos, enterramientos, simulacros de fusilamiento, sometimiento al hambre atroz y abusos sexuales”.
En el informe de admisibilidad, los comisionados recuerdan que las torturas a los conscriptos se dieron bajo contexto de la dictadura militar. “Durante ese período se han cometido aberrantes hechos por parte de las Fuerzas Armadas argentinas que han avasallado derechos humanos, se han producido asesinatos y desapariciones de miles de personas”, asentaron en el texto los integrantes de la CIDH.
Además, el organismo recordó su visita a Argentina en septiembre de 1979 y la publicación del documento que realizó al año siguiente, donde constató la sistematización de un aparato represivo en el país, coordinado por las FF.AA, que implicaba secuestros, torturas, desapariciones forzadas y apropiación de recién nacidos.
De esta manera, la Cecim tendrá cuatro meses para aportar nueva información a la CIDH, plazo que podrá extenderse por otros dos meses más.
De la primera denuncia a la presentación del caso ante la CIDH
En 2007, un ex soldado conscripto presentó la primera denuncia por los sometimientos sufridos mientras brindó sus servicios a la patria durante el conflicto bélico de 1982. El juzgado de Río Grande comenzó las averiguaciones, pero, dos años más tarde, la Cámara Federal de Casación Penal falló a favor del militar retirado Jorge Taranto, al determinar que los posibles delitos habían prescripto por el paso del tiempo.
El máximo tribunal del país respaldó a Taranto al considerar que los padecimientos de los soldados no podían ser contemplados como delitos de lesa humanidad, y que, por ende, ya no había posibilidad de juzgar a sus responsables. En febrero de 2019, la Corte Suprema convalidó la decisión de la Cámara de Casación.
Ante la inoperancia judicial, la Cecim acudió a la CIDH, con la presentación del caso el 25 de mayo de 2015. Allí, los peticionarios sostenían que el Estado argentino había violado los derechos humanos de los ex combatientes y de sus familiares primero con las torturas y después con la demora injustificada a la hora de investigar.

“Hoy, 8 años después, recibimos con emoción la admisibilidad del caso. La Comisión Interamericana comprende que el Estado argentino debe ser evaluado y juzgado en instancias internacionales, contraponiendo toda la prueba que existe por torturas a soldados”, destacó, Ernesto Alonso, secretario de DD.HH del Cecim.
Y agregó: “Hay derechos humanos en juego, el derecho al acceso a la justicia para obtener una reparación integral, pero también hay otros derechos muy importantes en juego, como el de la integridad personal, no ser sometido a torturas, a poder desempeñar la vida sin ninguna degradación”.

“En épocas en que la apología de la dictadura irrumpe en la escena, el CECIM vuelve a construir la pedagogía de paz y a reescribir una parte de la historia: la guerra de Malvinas fue un capítulo más de la dictadura militar”, remarcó, a la vez que expresó su solidaridad con “las víctimas, casi 100” e hizo un llamado “Memoria, Verdad, Justicia, Soberanía y Paz”.
